A second Colorado police officer has been acquitted in the 2019 death of Elijah McClain, a young, unarmed Black man whose case attracted national attention and became central to debates about police brutality and race. Mr. McClain, a 23-year-old massage therapist, was approached by Mr. Woodyard after a 911 caller described him as “sketchy.” Mr. Woodyard quickly put his hands on Mr. McClain without explaining the reason for the stop, according to state prosecutors. The officer remains suspended from the department without pay, pending the outcome of the trial. Prosecutors initially declined to bring charges against the officers and paramedics involved in McClain’s death, but the case received renewed scrutiny following the nationwide Black Lives Matter protests in the spring of 2020. Jared Polis appointed a special prosecutor to reexamine the case, and in 2021 a grand jury indicted Woodyard, two other officers and two paramedics in McClain’s death. A leading doctors group on Thursday formally withdrew its approval of a 2009 paper on “excited delirium,” a document that critics say has been used to justify excessive force by police. The American College of Emergency Physicians in a statement called the paper outdated and said the term excited delirium should not be used by members who testify in civil or criminal cases. Earlier this week, California became the first state to bar the use of excited delirium and related terms as a cause of death in autopsies. Other medical groups, including the American Medical Association, had previously rejected excited delirium as a diagnosis. The emergency physicians group had distanced itself from the term previously, but it had stopped short of withdrawing its support for the 2009 paper.

Why It MattersMr. McClain’s death in August 2019 drew new scrutiny after the murder of George Floyd in Minneapolis nine months later. The May 2020 killing of Mr. Floyd, videotaped by a bystander, ignited a national movement around police brutality and racial injustice. Mr. McClain’s death was quickly linked with the deaths of Mr. Floyd and Breonna Taylor, a Black medical worker who was shot and killed by the Louisville police in a botched no-knock raid. In addition, the death of Mr. McClain set in motion multiple investigations into the Aurora Police Department resulting in a state consent decree as well as local reform efforts. At the time the police stopped Mr. McClain, he was wearing a dark mask (his mother said he had anemia which could make him cold) and waving his arms.

GOP lawmakers introduced a bill to overturn Biden's new SAVE income-driven repayment plan. Borrowers can now apply for the SAVE plan before bills become due next month. It also estimated that an additional 1 million low-income borrowers would experience that benefit, and the plan would save all other borrowers at $1,000 a year compared to other income-driven repayment plans. However, the Republican lawmakers seeking to overturn that plan argued it's an overreach of authority and would cost taxpayers. While Republicans opposed that relief, as well, Biden is moving forward with implementing the new repayment plan as borrowers begin to face another monthly bill.
